Introduction

Welcome to LoveForever AI! These Terms of Service ("Terms") govern your access to and use of our AI-powered character generation platform, including our website at loveforever.ai and develop.loveforever.ai (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using LoveForever AI, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility and Age Requirement

By using the Service, you represent and warrant that:

• You are at least 18 years of age and can provide proof of age if requested
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law
• All information you provide is accurate, current, and complete
• You will not allow minors to access your account or use the Service through your account

We reserve the right to request age verification documentation at any time. Accounts found to be used by individuals under 18 will be immediately terminated.

2.1 Age Verification (UK/EU Users)

In compliance with the UK Online Safety Act and similar EU regulations, users accessing the Service from the United Kingdom, European Union, and other regulated jurisdictions are required to complete age verification through our trusted partner, Go.cam.

• Verification Methods: Quick selfie scan (AI age estimation), government ID document scan, credit card verification, or email verification
• Privacy Protection: Go.cam uses secure encryption; photos and documents are processed in real-time and not stored
• Data Minimization: We only receive a pass/fail age confirmation from Go.cam - we never see your ID documents or biometric data
• One-Time Verification: Once verified, your status is stored securely for 1 year

Users in non-regulated regions may use simple age confirmation, though we reserve the right to require full verification for any user at any time.

3. Account Registration and Security

3.1 Account Creation

To access certain features of our Service, you must create an account. You may register using:

• Email and password
• Google OAuth (Sign in with Google)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason.

4. Use of the Service

4.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

4.2 Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Generate content depicting minors in any inappropriate context
• Infringe upon intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Impersonate any person or entity
• Collect user information without consent
• Use the Service for commercial purposes without authorization
• Engage in any activity that is illegal under any applicable law, or that violates the rules, standards, or regulations of any card association or payment network, including without limitation Visa, Mastercard, Discover, American Express, and any other network used to process transactions on the Service

You further agree that your use of the Service must at all times comply with all applicable laws, regulations, and the operating rules and standards of any card association or payment network that processes your transactions.

4.3 Prohibited Content Policy

Our platform uses automated content moderation to ensure compliance with our policies. All prompts are scanned before processing.

4.4 Content Moderation

We reserve the right to review, monitor, and remove any content that violates these Terms or is otherwise objectionable, at our sole discretion. We employ both automated filtering and manual review processes to enforce our Content Policy.

4.5 Content Reporting and Removal

We provide a clear and accessible channel for anyone — users and non-users alike — to report questionable material or request removal of content. Copyright holders, people depicted in content, parents, legal representatives, and the general public may all file a request through our dedicated page at loveforever.ai/content-removal or by emailing info@loveforever.ai.

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of any prompts, descriptions, or input you provide to the Service ("User Input"). By submitting User Input, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Input solely to provide and improve the Service.

5.2 Generated Content

AI-generated images and characters created through our Service ("Generated Content") are owned by you, subject to these Terms. However, you acknowledge that:

• Similar or identical content may be generated for other users
• We retain the right to use Generated Content to improve our AI models
• You are responsible for ensuring your use of Generated Content complies with applicable laws

5.3 Our Intellectual Property

The Service, including its design, code, features, and underlying technology, is owned by LoveForever AI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

6. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate character images. You acknowledge and agree that:

• AI-generated content may not always be accurate, appropriate, or of expected quality
• We do not guarantee that Generated Content will meet your specific requirements
• Generated Content may inadvertently resemble real persons, and you are responsible for verifying you have the right to use such content
• We are not responsible for how you use Generated Content
• You are solely responsible for ensuring your use of Generated Content complies with all applicable laws and regulations

7. Voice Calls

Our Service offers optional real-time voice conversations with AI characters (“Voice Calls”). Voice Calls are powered by third-party voice infrastructure (including VAPI, ElevenLabs, Deepgram, and OpenAI). By initiating a Voice Call, you explicitly opt in to this feature and agree to the additional terms in this section.

7.1 Microphone Access

Voice Calls require access to your device’s microphone. Microphone access is requested only when you actively start a call and can be revoked at any time through your browser or operating-system settings. If you deny or revoke microphone access, the voice feature will be unavailable but all other features of the Service will continue to work normally.

7.2 Gem Billing and the First-Call Teaser

• Rate: Voice Calls are billed at a per-minute rate in gems, displayed on the call screen before you connect.
• Prepaid Blocks: Gems are charged in short prepaid blocks (typically one minute at a time) during the call, not up-front.
• First-Call Teaser: Your very first voice call on the Service includes a short free grace window (currently 30 seconds) so you can try the feature at no gem cost. After the teaser expires, normal per-minute billing begins.
• Insufficient Gems: If your balance falls below the minimum required to continue, the call will end gracefully and you will be prompted to top up before starting another.
• Automatic credit-back: Gems charged for a time block that was not actually delivered (e.g. due to a technical failure on our side) are automatically credited back to your in-app balance. If you believe you were incorrectly charged for voice time, you can request a refund through the channels in §9.4.

7.3 Recording, Transcripts, and Summaries

When you use Voice Calls, you understand and agree that:

• Recording: Audio from both sides of the call is recorded by our voice partner (VAPI) for the duration of the call.
• Transcription: Audio is automatically transcribed to text by a speech-to-text provider (Deepgram, via VAPI).
• Summarization: A short text summary of the call is generated by a large language model (OpenAI) and stored with the call record.
• Persistent Memory: Key facts from voice transcripts are extracted and stored as conversation memories so that future chat and voice sessions feel continuous. This is part of how the Service personalizes the experience; you can ask us to delete these memories at any time (see §7.5).
• In-App Playback: You can view your own call transcripts from the chat screen by tapping the call bubble.

7.4 Acceptable Use for Voice

All prohibitions in Section 4.2 and Section 4.3 apply equally to spoken audio on Voice Calls. In addition, you agree not to:

• Attempt to use Voice Calls to harass, threaten, or harm real individuals, including by impersonating them
• Record or rebroadcast Voice Calls outside the Service without clear disclosure that the other party is an AI
• Use Voice Calls to attempt prompt injection, jailbreaks, or extraction of underlying system prompts
• Use Voice Calls for automated telemarketing, robocalling, or any use that would violate applicable phone-use laws in your jurisdiction

7.5 Your Controls

• End Anytime: You can end a Voice Call at any time by tapping “End call”; billing stops immediately at the end of the current prepaid block.
• Delete a Call: You can request deletion of any individual call record (recording, transcript, and summary) by emailing info@loveforever.ai with the date of the call.
• Delete Voice Memories: You can ask us to wipe the voice-derived memories stored against your account; this may reduce continuity in future conversations.
• Opt Out: Simply never start a Voice Call — all other features of the Service (text chat, image generation, gem purchases) remain fully available.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

8.1 Email Communications

By creating an account, you consent to receive email communications from LoveForever AI, including:

• Transactional Emails: Account confirmations, password resets, purchase receipts, and security notifications
• Service Emails: Feature updates, policy changes, and important service announcements
• Promotional Emails: Special offers, promotions, and product recommendations

You may unsubscribe from promotional and service emails at any time by clicking the "Unsubscribe" link in any email. Transactional emails necessary for the operation of your account cannot be opted out of. For more details, see Section 8.1 of our Privacy Policy.

9. Payment, Gems, and Fees

LoveForever AI uses a gem-based credit system for AI image generation and voice calls. Gems are purchased through our authorized payment partner, Epoch (epoch.com).

9.1 Gem Packages

• Entry Plan: 60 gems
• Standard Plan: 400 gems (includes bonus gems)
• Premium Plan: 900 gems (includes bonus gems)

9.2 Gem Usage

• Each AI image generation costs gems (amount varies by feature)
• Gems are deducted at the start of each generation
• If a generation fails due to a technical error on our side, the gems are automatically credited back to your balance
• Gems never expire - use them whenever you want

9.3 Payment Terms

• All payments are processed securely through our authorized billing partner, Epoch (epoch.com)
• Prices are in USD and include all applicable fees
• Refund eligibility and the refund process are described in §9.4 below
• We reserve the right to modify pricing with 30 days notice
• You are responsible for any taxes associated with your purchases

9.4 Refund Policy

We want you to have a good experience with LoveForever AI. If something goes wrong with a purchase, please contact us — every refund request is reviewed on its merits. Typical situations where we issue a refund include:

• Technical errors that prevented gems from being delivered to your account
• Duplicate charges caused by a payment-processor error
• Unauthorized or unrecognized charges on your payment method
• Account termination caused by an error on our side
• Any other circumstance in which a refund is required by applicable consumer-protection law

To request a refund, please contact us within 14 days of the purchase through either of the following channels:

• Our authorized billing partner, Epoch: visit epoch.com and use the billing support / "Find my Bill" form to locate your transaction and submit a request.

Refund requests submitted through Epoch are acknowledged within one (1) business day and resolved within five (5) business days. Where a refund is granted, the amount is returned to the original payment method; any corresponding gems are removed from your in-app balance. Gems that have already been consumed by generation or voice-call usage are treated as a delivered digital service; where applicable law requires a refund for consumed gems, we will honor it.

Our Service integrates with the following third-party services:

• Supabase: Authentication and database services
• Google OAuth: Secure sign-in with Google
• AI Services: Proprietary AI models for image generation and content moderation
• Epoch (epoch.com): Authorized payment processor and billing support for gem purchases
• Go.cam: Age verification for UK/EU compliance
• AWS S3: Secure image storage
• AWS Amplify: Application hosting
• Google Analytics: Anonymous usage analytics
• Klaviyo: Email marketing and communications

We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

11.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service or servers are free of viruses or harmful components
• Results obtained from using the Service will be accurate or reliable

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOVEFOREVER AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

12. Indemnification

You agree to indemnify, defend, and hold harmless LoveForever AI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Your User Input or Generated Content
• Any harm caused to others through your use of the Service

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At our sole discretion

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Dispute Resolution and Governing Law

14.1 Governing Law
